Do I need a lawyer to buy a property in Spain?
Buying a home does not generally require a lawyer. Independent advice can still help you review risks, negotiate terms and organise the transaction before you commit money.
Finding a home that fits your plans tends to speed up decisions: making an offer, paying a reservation or agreeing a signing date. At that point an important question appears: do I need to instruct a lawyer to buy in Spain?
As a general rule, instructing a lawyer is not a mandatory requirement to complete an ordinary sale. It can, however, be particularly worthwhile when you need advice on your own interests, when there are documentary doubts, or when you are about to take on commitments before the deed.
The decision should rest on the features of the transaction and on the support you need in order to understand and prepare it.
If a notary is involved, why instruct a lawyer?
The notary carries out the checks that belong to the office, controls the legality of the execution and advises the parties impartially. Their involvement provides legal certainty and goes well beyond witnessing a signature.
The buyer’s lawyer can carry out a review specific to the transaction, explain risks and negotiate terms in the client’s interest, within the professional engagement.
The Ministry of Consumer Affairs points out that the notary does not act as one party’s private lawyer, and indicates that independent advice may be advisable where there are complex doubts or conflicts of interest.

When you are about to sign a reservation or arras
Advice can be useful before the first payment. You need to understand what you are accepting, when you can recover the money and what would follow if the transaction were not completed.
The Consejo General del Notariado recommends finding out before signing agreements or handing over money. It also points out that a private document can create obligations from the moment of signature.

You can ask the lawyer to review the document and propose terms covering outstanding documentation, financing or the condition of the property.
When there are charges or doubts about ownership
A mortgage, an attachment or a usufruct requires understanding its scope and how it affects the purchase.
The nota simple lets you check ownership and the charges or limitations registered. According to the Ministry of Consumer Affairs it is especially useful before paying money or signing, although its nature is informational.

The legal review can help you interpret that information and pin down which documents, agreements or steps need preparing.
When you buy off-plan
With a home under construction you must organise payments before receiving the property. It is worth reviewing who is selling, what will be built, the dates, the guarantees for advance payments and the consequences of changes or delays.
Official information on buying property highlights specific checks on the developer, the land and the licence when buying off-plan.

When you buy from abroad
Support can be worthwhile if you do not know the Spanish system, are not comfortable with legal language, or need to coordinate the transaction at a distance.
The UK Government guidance on buying in Spain recommends independent, specialist legal advice and checking the professional’s qualification.

Agree how you will receive explanations, who will review the documents and how decisions on payments, deadlines and signing will be communicated.
When the purchase depends on a particular purpose
If you want to let, renovate, extend or change the use of the property, explain that aim from the outset.
You can ask for a legal review of its feasibility and of the documents required before taking on commitments. Where technical checks are needed, they should be coordinated with the competent professional.
Which services should the engagement include?
Not all property advice has the same scope. Before instructing anyone, identify what you need and ask for a specific proposal.

Also ask which checks depend on third-party information and which may require a separate technical report.
How to check the lawyer’s independence
A recommendation from an agency or another person can make contact easier, but it is worth establishing who the client will be and whose interests the professional will defend.
Article 51 of the Estatuto General de la Abogacía Española governs conflicts of interest. A recommendation does not by itself prove that a conflict exists, but neither does it replace checking for one.

Before instructing, ask:
- Are you acting on my instructions as the buyer?
- Are you also acting for another party in this transaction?
- Which relevant relationships should be disclosed?
- Who will handle my file and answer my questions?
The answer should let you understand the professional relationship without relying on assumptions.
Fees: what you should receive before work starts
Article 48 of the Estatuto General de la Abogacía requires information on professional identity, the bar association and membership number, contact details, and fees and costs by means of an engagement letter (hoja de encargo) or equivalent.

Ask for a quote that distinguishes:
- Services included and excluded.
- Fees and applicable taxes.
- Third-party costs.
- Payment schedule.
- Terms if the transaction does not complete.
- Possible additional steps.
Comparing only a percentage or a total figure may be insufficient where the services differ.
The engagement letter should reflect what you need
The hoja de encargo records the terms of the service, the steps envisaged and the fees. The Ministry of Consumer Affairs explains that it helps make the professional relationship clear and to evidence what was agreed.

For example, if your priority is reviewing the planning position or a financing condition, ask for its treatment to be identified in the engagement. Avoid general wording that does not make clear what will be checked.
Frequently asked questions
Does the lawyer guarantee that no problem will arise?
A transaction with no risk at all should not be promised. The service should specify the checks, the limits of the information available and the steps recommended so that you can decide on an informed basis.
Can I instruct a lawyer after I have already paid the reservation?
Yes, advice can be sought afterwards. Provide the signed document, the payment receipt and the correspondence. The analysis must start from the commitments already taken on.
Do I need a different lawyer if the seller already has one?
The seller’s lawyer does not thereby become your adviser. If you want advice of your own as the buyer, it must be clear who will provide it and on what terms, respecting the rules on conflicts of interest.
Does the lawyer’s review replace the technical inspection?
No. Assessing structure, installations, damp or other construction matters may require a technical professional. Ask how the technical findings will be coordinated with the legal review.
Decide with a clear engagement, before committing money
Having a lawyer can help you understand the documentation, negotiate terms and organise the necessary steps. To judge whether it is useful for you, identify the particular features of your purchase and ask for a specific scope of work.
