Can You Apply for a Spanish NIE Without Travelling to Spain?

If you live abroad and need an NIE to buy a property or deal with an inheritance in Spain, you can consider applying through a consulate or through a representative. Here is what is worth preparing.

International BuyersBuying Property in Spain

If you are preparing to buy a property in Spain from your country of residence, you may need to obtain an NIE before completing the transaction. One of the first questions is usually whether you will have to travel to Spain solely for this formality.

There are ways to apply for an NIE without travelling to Spain in person: filing through the Spanish consular office corresponding to your residence, and applying in Spain through a duly accredited representative. The choice should be reviewed according to your circumstances and the instructions of the competent office.

At MH Legal & Seguros we explain how to organise this formality and what is worth checking so that it fits in with your purchase or with other asset matters.

Before you start: check whether you already have an NIE

If you have previously lived, worked or carried out formalities in Spain, review the documentation available before starting an application.

An NIE may already appear on a certificate, a card or the paperwork for an earlier transaction. Tell the professional handling your file so that they can check how to evidence it.

It is also worth distinguishing between needing a number for the first time and needing documentation that evidences one already assigned. Framing the formality correctly from the outset avoids unnecessary steps.

Applying for an NIE through the Spanish consulate

If you are outside Spain, one of the available routes is to file the application through the Spanish consular office corresponding to your place of residence.

Before preparing the documentation, check the instructions of that office. You should confirm its consular district, how appointments are requested, which documents it requires and how the fee is paid.

This option allows the application to be organised from your country of residence, although it does not necessarily mean that the whole procedure can be completed online or without appearing in person. Confirm the filing conditions of the specific office.

Applying for an NIE through a representative in Spain

Another possibility is for a representative to file the application in Spain on your behalf.

To do so, they must evidence sufficient representation. Under the instructions of the Ministry of the Interior (Ministerio del Interior), the power of attorney must expressly include the authority to file the NIE application.

That is why, before signing a power of attorney, it is worth checking that its content is appropriate for this formality. It should not be assumed that any authorisation or power drafted for another purpose will be sufficient.

If you are also going to entrust representation for the purchase, review jointly which acts you need to delegate. The NIE application and the signing of a deed are separate formalities and must each be properly covered.

What to review if you grant a power of attorney abroad

Before going to a notary or another authority in your country, it is advisable for the professional who will use the power in Spain to review the proposed text.

There are three points worth coordinating:

  • Content: which acts the representative will be able to carry out.
  • Form of the document: how it must be executed for use in Spain.
  • Its presentation: whether it requires an apostille or legalisation and translation, depending on the country, the language and the applicable rules.

These requirements must be checked for the specific document. Preparing them before execution helps avoid having to correct the power or sign a new one.

What documentation is worth preparing

Although you must follow the instructions of the office handling the application, the basic documentation comprises:

  • Official form EX-15, completed and signed.
  • A valid identity or travel document, with the required copies.
  • An explanation of the economic, professional or social reason for the application.
  • The supporting documentation that applies.
  • Proof of payment of the applicable fee.
  • If a representative acts, documentation evidencing their identity and representation.

In Spain, the procedure uses form 790, code 012, to pay this fee. If the application is filed through a consulate, the payment instructions of that office must be followed.

How to coordinate the NIE with a property purchase

The NIE should form part of the preparation of the transaction from the outset.

When you organise your purchase, review who the buyers will be, whether each of them has the necessary identification and which formalities will be carried out in person or through a representative.

For example, if you are buying with your partner and both of you will appear as purchasers, it is worth reviewing both sets of documents from the start. Preparing only one may leave part of the transaction outstanding.

It is also advisable to coordinate:

  • The legal review of the property.
  • The deadlines in the reservation document or the contract.
  • The preparation of powers of attorney.
  • The arrangement of funds and means of payment.
  • The expected date for the deed.

The NIE application is one part of that preparation. It should progress in coordination with the other checks.

When to start and which timeframes to allow for

If you know you will need an NIE, review the application route and the corresponding documentation as early as possible.

When planning, do not rely only on the time needed to decide the file. You should also allow for the preliminary steps: preparing documents, obtaining an appointment and, where relevant, executing and sending a power of attorney.

Before committing to a signing date, confirm which formalities are still outstanding and how much room there is to complete them.

A forecast adapted to the specific case is more useful than assuming that every office and every application will follow the same timetable.

Mistakes worth avoiding

When preparing an application from abroad, pay particular attention to the following situations:

  • Starting a new application without checking whether you already have an NIE.
  • Going to a consulate without reviewing its district and instructions.
  • Signing a power of attorney without checking that it allows the NIE to be applied for.
  • Preparing foreign documents without reviewing their translation or legalisation.
  • Leaving the identification of one of the buyers until the last moment.
  • Confusing obtaining an NIE with a right to reside in Spain.

The NIE is an identifier. Its assignment does not by itself grant authorisation to reside or work in Spain.

Frequently asked questions about applying for an NIE from abroad

Can I obtain an NIE without travelling to Spain in person?

Yes. You can consider applying through the Spanish consulate corresponding to your residence or filing in Spain through a representative holding a sufficient power of attorney. You should check the requirements of the route you choose.

Does applying from abroad mean doing it entirely online?

Not necessarily. You must follow the procedure of the competent office and confirm its requirements on appearance and filing. It should not be assumed that the formality can be completed entirely at a distance.

Is a power of attorney enough to buy a property?

Its content must be reviewed. For an application through a representative, it must expressly include the authority to file the NIE application.

Do I need to be a resident in Spain to apply?

No. An NIE can be applied for on economic, professional or social grounds even if you do not plan to reside in Spain. You must justify the reason for the application.
