Inheritances & Wills

At MH Legal & Seguros, we help you plan your succession or navigate an inheritance involving assets in Spain. We advise on wills, beneficiaries' rights and the transfer of inherited assets, coordinating documents, notarial formalities and tax filings. Where more than one country is involved, we work with overseas advisers to connect the arrangements and explain each step.

Inheritances & Wills

MH Legal & Seguros advises Spanish and international clients on wills, succession planning and inheritances involving assets in Spain. We assist with preparing testamentary arrangements, establishing beneficiaries' rights, administering estates and resolving inheritance disputes.

Whether you are planning ahead or dealing with an inheritance, we explain the legal requirements and coordinate the practical steps, including matters involving several countries or beneficiaries living abroad.

How We Help

01

Wills & Succession Planning

We prepare and review testamentary arrangements and coordinate signing before a Spanish notary. Our advice considers your wishes, family circumstances, assets and existing wills, helping ensure that documents made in different countries work together.

We assess the suitability and scope of a Spanish will, any available choice of national law and its effect on earlier arrangements. Plans can also be reviewed following changes in family relationships, residence, nationality or significant assets.

02

Family Protection & Inheritance Rights

We assess the position of spouses, children and other beneficiaries, including protected inheritance rights and reserved shares. Particular attention is given to the family home, shared assets and the distinction between ownership and rights to use or benefit from property.

The review identifies the applicable succession rules, including any relevant Spanish regional civil law provisions, and explains how they affect your intended arrangements or entitlement.

03

International Inheritances & Foreign Wills

We coordinate the Spanish part of international estates, working with overseas advisers where necessary. This includes reviewing foreign wills, succession documents and proceedings, assessing their effect in Spain and identifying further requirements.

We examine the documents' scope, interpretation, choice of law and potential conflicts or revocation of other wills. Where foreign arrangements require additional analysis or adaptation for Spanish assets, we coordinate the appropriate advice and formalities. Succession law, taxation and registration requirements are considered separately.

04

Estate Administration & Representation

We help establish entitlement, including where no will exists, review assets and liabilities, and prepare the acceptance and distribution of the inheritance.

Our work includes gathering certificates, information from the Spanish Register of Last Wills, testamentary documents, property records and financial information. We coordinate translations, apostilles, legalisation and evidence of foreign law where required.

Beneficiaries unable to attend in person can receive advice on powers of attorney tailored to the intended inheritance formalities or a subsequent sale.

05

Tax, Asset Transfers & Inherited Property

We identify relevant deadlines from the outset, assist with Spanish inheritance tax filings and coordinate asset transfers with notaries, banks and registries.

For inherited property, we explain full ownership, shared ownership, usufruct and other relevant rights. The inheritance work is coordinated with your plans to retain, manage, divide or sell the property, including the ownership arrangements and documentation needed for the next stage.

06

Inheritance Disputes

We advise on disagreements concerning wills, entitlement, estate assets, distribution and the use or sale of inherited property.

Our assistance includes reviewing the beneficiaries' positions, negotiating between interested parties and pursuing or defending proceedings before the Spanish courts where required.

Our Process

  1. 1

    Initial Review

We review the deceased's circumstances, beneficiaries, Spanish assets, existing wills and overseas documents, identifying urgent deadlines and defining the scope of the work.

We assess the succession rules and establish the documents needed to confirm beneficiaries' rights, coordinating with foreign advisers where necessary.

  3. 3

We gather certificates and financial and property records, review assets and liabilities, and address missing documents, translations and representation arrangements.

  4. 4

    Acceptance & Distribution

We explain the proposed arrangements before signing and coordinate the relevant notarial documentation. Any disagreements are assessed before proceeding.

    Your Plans for the Property

We coordinate any further work needed to retain the property, reflect shared ownership or prepare a sale, providing continuity between the inheritance and the property transaction.
